 民眾提點子成案 剝奪人民基本權不能公投


（中央社記者劉麗榮台北8日電）聯合國官員批評同婚公投，認為人權不該表決。有民眾提案，不得透過提公投案剝奪、限制或減少人民享有的基本權。短短幾天已成案，中選會必須在明年2月6日前回覆

國家發展委員會設立的公共政策網路參與平台的「提點子」服務，開放民眾就關注的議題提案，60天內附議人數達5000人即成案，主管機關須於2個月內具體回應參採情形，並且在平台上公布。

依據現行公投法第2條規定，預算、租稅、薪俸及人事事項不能公投。全國性公民投票，依憲法規定外，其他適用事項包括法律的複決、立法原則的創制和重大政策的創制或複決。

由於人權並未納入不能公投事項，有民眾在公共政策網路參與平台提議修正「公投法」，以法律明定不得透過提出公投案的方式來剝奪、限制或減少人民享有的基本權。其提出的公投案內容意在保障、增加人民權益公投，不在此限。

東吳大學法律系副教授胡博硯指出，美國、德國的公投法都有規定，人權不能公投，不過，他們是可以推動修憲公投，所以才會有此規定。而台灣的公投法是在憲法架構下，有關修憲議題是不能公投的，所有公投題目都只能修法，不能違背或修改憲法。（編輯：鄭雪文）1071208






 南韓《與神同行》續集將上映 5演員來台催票房


電影《與神同行》續集即將上映，主要演員河正宇、朱智勛、金香起、馬東石、金東旭抵台，今天（8月5日）晚間在台北市政府前廣場舉行首映紅毯見面會，雖然頂著35度高溫，演員們展現親民作風，簽名、拍照都來者不拒，光是紅毯就花了將近一個小時才走完。

韓國演員朱智勛穿著粉色西裝，帥氣踏上紅毯，讓守候已久粉絲都瘋狂了，尤其接下來超親民動作，完全融化台灣粉絲的心。

飾演江林的何正宇直說，自己跟角色個性超不像，但3位陰間使者續集就是要完成轉世願望，「解怨脈」朱智勛就笑說，如果轉世想變成「家神」馬東石，因為可以打倒殭屍。

5位演員加導演，來台4天3夜賣力宣傳，就看續集能否再締造票房佳績。
